Welcome to Viberse. This Privacy Policy applies to the Viberse app (”the Platform”) and our related website, services, applications, and products (collective, “the Service”) provided by Viberse or one of its affiliates (”Company”, “we” or “us”).

We are committed to protecting and respecting your privacy. This Privacy Policy explains how we collect, use, share, store, and otherwise process the personal information of users, and other individuals in connection with Viberse. If you do not agree with this policy, you should not use the Platform.

Our Platform is for users aged 17 and older. You must be able to consent to the processing of personal data in your country in order to use our Service. Where possible, we may allow your parents to consent on your behalf.

1. Personal Information We Collect

When you interact with Viberse, we may collect the following information:

Information We Collect

Profile information. When you register on the Platform, we collect essential information necessary for us to offer our services. This includes your username, password, email address, date of birth (if applicable), gender (if applicable), nationality (if applicable), and profile photo. You may also choose to add additional information, such as your bio and phone number, to your user profile and account settings.
Adding a phone number to your account is entirely optional. If you choose to provide a phone number, it may be used to:
Strengthen trust on the Platform, creating a community where real Vibers share real moments and interact authentically.
Support future features, like two-factor authentication and SMS-based account recovery.
Your user profile, which includes your username, profile photo, and bio, is always public.
Payment Information. This includes payment information you provide to us in order to purchase offerings provided as part of our paid products and services, including your credit or debit card number, card expiration date, CVV code, and billing address.
Preferences. This includes the settings you choose in your account, such as content types, comment order, and mention settings.
User content. This includes the content you post or upload on the Platform, such as text, images, and videos you create or upload, and comments you make (”User Contributions”).
User contacts: If you sync your address book to our Platform, we collect and store the information of your contacts.

Automatically Collected Information

Technical information. We collect certain data about the device you use to access the Platform, including your IP address, time zone settings, device identifiers, device model, operating system details, app and file names and types, audio settings, and connected audio devices. This helps us understand your usage across difference devices. For example, when you log in from multiple devices, we will be able to use your profile information to identify your activity across devices. We may also associate you with information collected from devices other than those you use to log in on the Platform.
Location information: We collect information about your location. This ranges from your current location, GPS data, places you’ve been, businesses you’ve patronized, as well as any information inputted on your profile. You may choose whether to share this information with us through your device’s settings.
Image and video information: We may collect information about the images and videos that are part of your User Contributions, such as identifying the objects and sceneries that appear in a video, the people and location within an image, and the text of the words used in your User Contributions. We may collect this information to enable content moderation and content recommendations.
Messaging: We collect information whenever you send a message. The information we collect is limited to the fact that a message was sent, who it was sent to, and where it was sent from. Your messages are encrypted, and we do not read your messages unless there is a user report for messages that violate our Community Guidelines.
Cookies. Cookies are small pieces of text used to store information on web browsers. They, along with other technologies used to automatically store and receive identifiers and other information on computers, phones, and other devices, are collectively referred to as “Cookies.” We use Cookies to collect data from users who use the Viberse app (”Platform”) and our related website, services, applications, and products (“Service”). They enable us to offer the Platform and the Service to you and to understand the information we receive about you, whether you are registered or logged in or not. Cookies help us protect your account and data, remember your settings and preferences, analyze how you interact with our content, show you relevant content and ads, and provide you with the best experience possible. The data collected through Cookies is processed according to this Privacy Policy. You can learn more about how we use cookies and similar technologies here.
Device based permissions. We collect information that you have authorized your device to share with us. You can usually find these permissions on the Settings application of your device. This can include GPS settings, camera access, microphone access, your photos, and other related data.

Information Collected Based On Your Activities

Platform activities. We collect information whenever you post or share content on our Platform. We also collect information whenever you interact with another user’s post such as when you like, comment, or share these posts. If other users interact with you or your content on the Platform we collect that too.
Connections. We collect data on the pages you follow, the people you connect with on our Platform, and the groups you join or manage. We also collect information based on how often you interact with these connections.
Messaging. We collect information whenever you send a message. The information we collect is limited to the fact that a message was sent, who it was sent to, and where it was sent from. Your messages are encrypted, and we do not read your messages unless there is a user report for messages that violate our Community Guidelines.
Internet browsing activities. We collect information on how you use the internet or what websites you visit through your cookies. We may also collect information based on your purchases on other websites such as Amazon or Alibaba. This also includes the types of ads you interact with.
App usage. We collect information based on the apps you use, and how you use our application. This can range from the types of apps you prefer, how much time you spend on them, how much money you spend on them, and whether the apps run in the background.

2. How We Collect Information

We may collect information:

Directly from you: When you provide the User Contributions, including posting images, uploading videos, interacting with content posted by others, or contacting us through any form throughout the Service.
Automatically: As you interact with the Platform, including login times and dates, content interactions, submission times, post and comment dates within Viberse.
From third parties: Including analytics and communications that the Company uses to operate the Service.
From your device’s clipboard: With your permission, we may access content, including text, images, and videos, stored in your device’s clipboard. For example, if you choose to share content with a third-party platform, or choose to paste content from the clipboard into the Platform, we access this information stored in your clipboard to fulfill your request.

3. How We Use Information

We use your information to improve, support and administer the Platform, to allow you to use its functionalities, to promote the Platform, to optimize your user experience, and to fulfill and enforce our Terms of Use.

We may use your information in the following ways:

To fulfill your requests for the services, products, functionalities, support and information for internal operations, including troubleshooting, data analysis, testing, research, and statistics.
To display the content you see when you use the Platform, such as recommended posts based on users you follow or posts you interact with.
To send promotional materials, including by in-app message or email, from us or on behalf of our affiliates.
To improve and develop our Platform and conduct product development.
To measure and understand the effectiveness of the content we serve to you and other users on the Platform.
To support the social functions on the Platform, including allowing you and others to connect, share, and interact with User Contributions posted through the Platform.
To enable the content in your posts for selected topics to be used in other users’ posts.
To allow you to participate in the interactive features of the Platform, such as enabling the content you created for selected topics to be used in other users’ posts.
To use User Contributions as part of our marketing campaigns to promote the Platform, invite you to participate in events, and promote popular topics and posts on the Platform.
To help us detect and combat abuse, harmful activity, fraud, spam, and illegal activities on the Platform.
To notify your connections when you are active or when you were last active on the Platform.
To ensure content is presented in the most effective manner for you and your device.
To promote the safety and security of the Platform, including by monitoring, analyzing, and reviewing User Contributions for violation of our Terms of Use or Community Guidelines, and other conditions and policies.
To communicate with you, including notifying you about changes in our services.
To provide user support, including responding to your questions, feedback, or other requests.
To enforce our Terms of Use, Community Guidelines, and other conditions and policies.

4. How We Share Information

WE DO NOT SELL OR SHARE YOUR PERSONAL INFORMATION with third parties for third-party marketing purposes or for any other purpose other than as described in this Privacy Policy. We may share the information we have collected about you, including personal information, as disclosed at the time you provide your information with the following parties:
There are seven ways we may share your information.
With the general public. Your profile on Viberse is public. This means your content will be visible to anyone on the Platform and may be accessed or shared by friends, followers, and third parties such as search engines.
With other Viberse users. When you post and share on the Viberse app, we share your content, such as images and videos, interactions with other users’ content, such as comments, likes, and people you follow, and content you send to a specific user, such as direct messages.
With business partners. If you choose to register the Platform using your social network account details (e.g., Facebook, Google), we may share certain information with the relevant social network, such as your username, access token, and the referring URL.
With service providers. We provide information and content to service providers who support our business, such as cloud service providers to ensure that the Platform is a safe and enjoyable place, service providers that assist us in marketing the Platform, and analytics providers that help us optimize and improve the Platform.
With our corporate group. We may also share your information with other members, subsidiaries, or affiliates of our corporate group, including to provide the Platform, improve and optimize the Platform, prevent illegal use, and support users.
For administrative or legal reasons. We may disclose personal information about you if required to do so by law, or if such action is reasonably necessary to:
Comply with legal obligation, process or request.
Enforce our Terms of Use and other agreements, policies, guidelines, and standards, including investigation of any potential violation thereof.
Detect, prevent or address security, fraud or technical issues.
Protect and defend our rights, property, or safety of us, our users, a third party or the public as required or permitted by law.
In the event of business transactions. We may disclose and transfer all information related to the Platform, including but not limited to, your personal information and your usage information, to third parties:
In the event we sell or buy any business or assets, in which case we will disclose your data to the prospective seller or buyer of such business or assets.
If we sell, buy, merge, are acquired by, or partner with other companies or businesses, or sell some or all of our assets.

5. Where We Store Information

We use trusted third-party companies and individuals to help us provide, analyze, and improve the Service. We currently use Amazon Web Services (AWS)’s cloud services to store some of your information. You can find more information on data security on Amazon’s site.

6. How Long We Keep Your Information

We retain your personal information only as long as necessary to provide the Platform and fulfill the purposes outlined in this Privacy Policy. In certain cases, we may keep your information for a longer period to comply with legal obligations or resolve disputes.
Here’s how long we typically retain different types of information:
Account Data: Indefinitely, as long as you have an active account with Viberse. This is necessary to provide you with our services. This information, including your username, password, and phone number (if provided), will be deleted when your account is deleted.
Content Data: Indefinitely, as long as you have an active account with Viberse, or until your content is deleted.
Interaction Data: Indefinitely, as long as you have an active account with Viberse, or until you choose to delete the interaction data. This includes, but is not limited to, your comments and likes.
Geolocation Data: For the period you have shared your geolocation data as part of the content with us. It will be kept as long as the content is stored in our systems, or until either the content or your account is deleted.
Keep in mind that public content can exist elsewhere even after you remove it from Viberse. For example, search engines and other third parties may retain copies of your posts longer, based on their own privacy policies, even after they’re deleted or expire on Viberse.

7. Your Rights and Ours

You have rights and choices regarding your personal information under applicable laws. These include the right to access, update, delete, or rectify your data, as well as the right to understand how your data is processed and to file complaints with authorities if necessary.

Your Rights

Access or update your information. You can view and edit most of your profile information, such as your bio and profile photo, directly in your user profile. To update information like your email address or phone number (if provided), contact us at support@viberse.com.
Delete your account. If you no longer wish to use Viberse, you can delete your account in your Account Settings. Deleting your account will permanently remove your contributions (e.g., posts, comments). However, information others have shared about you is not part of your account and will remain. For more information on how to delete your information, see below.
Delete your information. If you wish to delete information about you within the Service, contact us at support@viberse.com. For example, you may specify you wish to remove certain account information in your email. However, we may need to retain certain information for record-keeping purposes, to complete transactions, or to comply with our legal obligations.
Opt out of marketing communications. You can unsubscribe from marketing-related emails by clicking on Unsubscribe at the bottom of the email or changing your Email Subscription preferences in your settings. You may continue to receive service-related and other non-marketing emails.
You may submit a complaint about our use of your personal information or our response to your requests by contacting us at support@viberse.com. European residents may also submit a complaint to the data protection regulator in your jurisdiction.

Additional Rights for EEA Residents

If you are a resident of the European Economic Area (EEA), you have the following data protection rights under the General Data Protection Regulation (GDPR):
Right to access. You can request access to the personal data we hold about you.
Right to rectification. You can request that we correct any inaccuracies in your personal data.
Right to delete. You can request that we delete your personal data under certain conditions.
Right to restrict processing. You can request that we restrict the processing of your personal data under certain conditions.
Right to data portability. You can request to receive your personal data in a structured, commonly used, and machine-readable format.
Right to object. You can object to the processing of your personal data under certain conditions.
Right to withdraw consent. You can withdraw your consent at any time by contacting us at support@viberse.com.
Right to complain. You have the right to lodge a complaint with a supervisory authority.

How We Process Your Data

We process your data based on the following legal bases:
Consent. When you have given us consent to process your personal data for specific purposes.
Performance of a contract. When processing is necessary for the performance of a contract to which you are a party.
Legal obligation. When we are required to process your data to comply with a legal obligation.
Legitimate interests. When processing is necessary for our legitimate interests, provided that your interests and fundamental rights do not override those interests.

If you have unresolved concerns, you have the right to lodge a complaint with a Data Protection Authority in your area. For EEA residents, contact your local data protection authority for assistance.

8. Security of Your Information

We make reasonable efforts to ensure your information is treated securely and in accordance with this policy. Unfortunately, no transmission of data over the Internet is 100% secure. Although we take measures to protect your personal data, we cannot guarantee the security of any information you transmit to us or information we transmit to you from the Platform, and you assume all related risks.

The necessary security measures we take to ensure the security of your personal data include  end-to-end encryption technology.

We use end-to-end encryption to safeguard your messages, calls, files, and personal information from unauthorized access and surveillance, ensuring protection against data breaches or hacking for both individual and business users.

The end-to-end encryption in the Viberse app adds extra security and protection to your messages and calls so only you and whoever you’re talking to can see, hear, or read them.

The content of your messages and calls in end-to-end encrypted conversations is protected from the moment it leaves your device to the moment it reaches the receiver’s device. This means that nobody else can see or listen to what's sent or said - not even Viberse. We couldn't even if we wanted to.

Nobody except authorized personnel with written consent can access your personal data. In certain cases, the Company may be required to continue to retain your data to comply with applicable law or in connection with a legal claim.

9. Eligibility and Age Requirements

Our Platform is not intended for individuals under 17 years of age. We do not knowingly collect personal information from individuals under 17. If you are under 17, do not use or provide any information on this Platform or through any of its features, register on the Platform, publish text, image or video on the Platform, comment under any post on the Platform, or provide any information about yourself to us, including your name, email address, or bio.

If we learn we have collected or received personal information from an individual under 17 without verification of parental consent, we will delete that information. If you believe we might have any information from or about an individual under 17, please contact us at support@viberse.com.

10. Privacy Policy Update

We may update this Privacy Policy from time to time. When we update the Privacy Policy, we will notify you by updating the “Last updated” date at the top of this policy and posting the new Privacy Policy or providing any other notice required by applicable law. Your continued access to or use of the Platform after the date of the updated policy constitutes your acceptance of the updated policy. If you do not agree to the updated policy, you must stop accessing or using the Platform.
